ABP session terms and conditions

1. Introduction

By participating in a session held by The Australian Breastfeeding Project, you agree to the following terms and conditions.

2. Indemnification

I understand and agree that the Photographer and The Australian Breastfeeding Project are not obligated to capture any specific moment, pose, or person(s) during the session. In the event that the photographer is unable to perform the services outlined in this contract due to circumstances beyond their control, such as cancelled sessions or data loss, I agree to indemnify the photographer for any loss, damage, or liability. However, The Australian Breastfeeding Project will refund all payments made by me in relation to the session, excluding instances such as a baby not feeding or time/date changes due to weather or illness. I also agree to hold The Australian Breastfeeding Project harmless from any liability, damage, or loss related to technological failure, including data loss. Furthermore, I agree to indemnify and release The Australian Breastfeeding Project and the photographer from any personal injury that may occur during the photo session. I acknowledge that I have the right to refuse any poses or situations that make me uncomfortable.

3. Copyright and Reproductions – Model Release

I hereby grant full copyright of photographs taken by the photographer for The Australian Breastfeeding Project. I authorize The Australian Breastfeeding Project and its representatives to use these photographs for editorial, trade, product advertising, normalising breastfeeding and other business purposes. I waive the right to inspect or approve the finished products or the advertising material where these photographs may be used. I release the Photographer and The Australian Breastfeeding Project from any liability arising from the taking or publication of said pictures. The Australian Breastfeeding Project retains the copyright and artistic rights to all images, and no alterations should be made to the images without their consent. Only the photographer is authorized to take pictures of the poses, lighting, or setups created during the session. I understand that taking pictures on personal phones is acceptable.

4. Client Usage

The digital copies of the photographs are intended for personal use only. The Client shall not sell or authorize reproductions of the photographs by any third party other than The Australian Breastfeeding Project. If any models under the age of 18 are involved, I confirm that I am their legal guardian and have the authority to sign a model release on their behalf.

5. Payment

All ticket fees are non-refundable, and payments for individual photos through the online gallery are also non-refundable due to the digital nature of the product.

6. Online Gallery

The online gallery will be accessible for two weeks from the upload date of the last image. After this period, the gallery can be reopened upon request after a month, but it will only be available for 24 hours. It is important to download purchased images within 7 days, as the download link will expire after that time. We can not guarantee images will be stored past the two week gallery opening so ensure you have saved your images to multiple locations.
